1. Agreement to Terms

By accessing or using the website earlrealestate.com (the "Site") and any services offered by Earl Real Estate, a DBA of Summerland LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site or our services.

2. Company Information

Earl Real Estate is a trade name of Summerland LLC, a Utah limited liability company.

3. Services

Earl Real Estate provides real estate development advisory, acquisition strategy consulting, and educational workshops and intensives ("Services"). Services are described on the Site and may be updated from time to time at our discretion.

4. Eligibility

You must be at least 18 years of age and legally capable of entering into binding agreements to use our Services. By using the Site, you represent and warrant that you meet these requirements.

5. Accounts and Registration

Some Services may require you to provide personal information or register for an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of any account credentials.

6. Purchases and Payments

If you purchase tickets, workshops, or other offerings through the Site, you agree to pay all applicable fees. Payment processing is handled by third-party payment processors. All prices are listed in U.S. dollars unless otherwise stated.

7. Refund and Cancellation Policy

Full refunds are available up to 14 days before the scheduled event date. Refund requests made within 14 days of the event will not be honored; however, tickets are transferable to another attendee. To request a refund, email intensive@earlrealestate.com with your order confirmation. Refunds are processed within 5-10 business days to the original payment method.

If Earl Real Estate cancels an event, all ticket holders will receive a full refund. In the event of rescheduling, ticket holders may transfer their registration to the new date or request a full refund.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and course materials, is the property of Summerland LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMERLAND LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Utah County, Utah.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
